Minor Participant Release Waiver of Liability, Assumption of Risk and Indemnification Agreement

This release waiver of liability, assumption of risk and indemnification agreement is freely given for, (Please print minor's full name and your full name)

____________________________________________________________________________, who is parent and/or legal guardian of minor child who shall hereinafter be referred as "PARTICIPANT", to General Sam's Off Road Wilderness Park, Inc. located in Huntsville, Texas , who shall hereinafter be referred to as the "COMPANY".

1. The PARTICIPANT fully understands and acknowledges that they are now freely choosing to allow entry of MINOR to COMPANY property and participate in activities on COMPANY property, whether as an operator or spectator or otherwise, that are inherently dangerous and that being engaged in the operation of, and/or being in the physical proximity to, all terrain vehicles, trucks, cars, jeeps, motorcycles, racing, or motorized or non-motorized machines of any kind bears known and accepted risks as well as unknown and unanticipated risks which could result in injury, death, illness or disease, physical, mental or emotional damage to themselves, their property, to spectators, or other third parties and/or their property.

2. The PARTICIPANT fully understands and acknowledges that being in an outdoor wilderness environment at any time could result in injury, death, illness or disease, physical, mental or emotional damage to MINOR, their property, or spectators or other third parties and/or their property. PARTICIPANT understands fully and also acknowledges that poisonous snakes, insects, spiders, animals both wild and domestic, which may be diseased and are potentially dangerous, and many other unspecified human hazards are LIKELY to be present on the COMPANY property.

3. The PARTICIPANT understands fully and acknowledges that COMPANY makes no expressed or implied representation as to the fitness for use of any kind, safeness, nor condition of any roads, tails, signs, buildings, poles, mud pits, creeks, ponds, deep water, ditches, gates or any other items or improvements on the property of the COMPANY including but not limited to trees, both standing and downed, rocks, hunting blinds and tree stands, erosion and generally dangerous conditions of the land both on and off trails and roadways, which may create hazardous riding, driving, viewing and walking conditions. PARTICIPANT understands fully and acknowledges these as hazards and that dangerous conditions are present and assumes all responsibility for MINOR completely.

4. PARTICIPANT acknowledges that MINOR'S participation in any type of activities on the COMPANY property is purely voluntary and now elects to allow MINOR entry into the COMPANY property by their own choice in spite of any and all risks and hereby releases, holds harmless, and indemnifies COMPANY from any and all claims whatsoever forever.

5. PARTICIPANT acknowledges that the personal image or likeness of MINOR or that of their property may appear in pictures on the COMPANY web site or in promotions or advertisements made by COMPANY and hereby releases the use of such images for such purposes fully without compensation or claim of any right or liability of any kind.

6. PARTICIPANT EXPRESSLY ACKNOWLEDGES THAT ANY INJURIES RECEIVED TO MINOR MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES BY COMPANY AND FULLY ACCEPTS ALL RESPONSIBILTY FOR ALL SUCH RISK.
7. PARTICIPANT acknowledges that the COMPANY reserves the right to refuse admittance to anyone for any reason at its sole discretion and the COMPANY also reserves the right to ask anyone to leave, without refund, at its sole discretion.
8. PARTICIPANT acknowledges that he willing destruction or defacement of any COMPANY holdings, belongings, equipment, buildings, signage, fencing, or any other items on or off COMPANY property is grounds for immediate departure of PARTICIPANT from the premises and PARTICIPANT will hereafter be barred from re-entry to COMPANY property for life, solely at the COMPANIE'S discretion. Additionally, PARTICIPANT acknowledges that should PARTICIPANT be found willfully destroying COMPANY property he or she will also be liable for any and all damages and will be required to pay all costs involved based on the current fair market retail value of both product and labor. PARTICIPANT indicates full understanding of these terms and agrees to such. 9. Being totally aware of and understanding and the above risks, nonetheless, the PARTICIPANT hereby EXPRESSLY AGREES, COVENANTS, AND PROMISES TO ASSUME AND ACCEPT ALL RESPONSIBILTY AND RISK FOR ANY INJURY, DEATH, ILLNESS OR DISEASE, OR DAMAGE TO MINOR, TO OTHERS, OR TO THEIR PERSONAL PROPERTY OR THE PROPERTY OF OTHERS INCLUDING THE COMPANY ARISING FROM THEIR PRESENCE ON ANY PROPERTY OF COMPANY AND FULLY ACCEPTS SOLD RESPONSIBITLY FOR ALL SUCH RISKS, HAZARDS AND DANGERS AND HEREBY COVENTS NOT TO SUE THE COMPANY for any occurrence of any kind. Furthermore, in exchange for MINOR'S permission to enter COMPANY property and engage in any of the activities described herein, PARTICIPANT hereby voluntarily releases, forever discharges and agrees to hold harmless and indemnify COMPANY, its agents or employees, contractors, officers, landlords. sub-lessors, owners, customers and all other persons or entities from all and any liability claims, demands, actions or rights of all actions, which are related to, arise out of, or in any way connect with any participation in use of any all terrain vehicle activity or any activity including specifically but not limited to the negligent acts or omissions of the COMPANY, its agents or employees, contractors, landlords, sub-lessors, volunteers, owners and all other persons or entities for any and all injury, death, illness or disease, and danger to PARTICIPANT or PARTICIPANT'S property. BY SIGNING THIS AGREEMENT, PARTICIPANT RELEASES COMPANY FOR ANY LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFROM ON ACCOUNT OF INJURY OF MINOR OR MINOR'S PROPERTY OR RESULTING IN MINOR'S DEATH OR THAT OF ANY OF MINOR'S NEXT OF KIN, RELATIVES OR FRIEND, WHETHER CAUSED BY THE NEGLIGENCE OF THE COMPANY OR OTHEWISE. IN SIGNING THIS DOCUMENT, PARTICIPANT EXPRESSLY ACKNOWLEDGES THAT THEY ARE HEREBY RELEASING THE COMPANY AND ITS OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES. GUESTS, EMPLOYEES, 3rd-PARTY CONTRACTORS AND VOLUNTEERS FROM ANY AND ALL LIABILITY FROM DAMAGE CAUSED BY ACCIDENT OR NEGLEGENCE OF ANY KIND.
9. This document, consisting of two typewritten pages, forms no entity, partnership or otherwise and is solely executed for the purposes stated herein and is the entire agreement between PARTICIPANT and COMPANY.

By affixing my signature hereunto, I now certify that I have read, understand, and agree fully to all the terms and conditions herein specified and understand fully the hazards present as set forth in this document and hereby release the COMPANY from any liability concerning MINOR.

Furthermore, I hereby certify that I am the MINOR'S (Please circle one only) PARENT | LEGAL GUARDIAN and now state that I have all necessary legal right to enter into such legal agreements regarding MINOR and assume all responsibility, liability and claims whatsoever for such.

Furthermore, in exchange for permission to enter COMPANY property and engage in any of the activities described herein, PARTICIPANT hereby voluntarily releases, forever discharges and agrees to hold harmless and indemnify COMPANY, its agents or employees, contractors, officers, landlords. sub-lessors, owners, customers and all other persons or entities from all and any liability claims, demands, actions or rights of all actions, which are related to, arise out of, or in any way connect with any participation in use of any all terrain vehicle activity or any activity including specifically but not limited to the negligent acts or omissions of the COMPANY, its agents or employees, contractors, landlords, sub-lessors, volunteers, owners and all other persons or entities for any and all injury, death, illness or disease, and danger to PARTICIPANT or PARTICIPANT'S property. BY SIGNING THIS AGREEMENT, PARTICIPANT RELEASES COMPANY FOR ANY LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFROM ON ACCOUNT OF INJURY OF PARTICIPANT OR PARTICIPAN'TS PROPERTY OR RESULTING IN PARTICIPANT'S DEATH OR THAT OF ANY OF PARTICIPANT'S NEXT OF KIN, RELATIVES OR FRIEND, WHETHER CAUSED BY THE NEGLIGENCE OF THE COMPANY OR OTHEWISE. IN SIGNING THIS DOCUMENT, PARTICIPANT EXPRESSLY ACKNOWLEDGES THAT THEY ARE HEREBY RELEASING THE COMPANY AND ITS OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES.
